Annual Access Inspections
Annual Access Inspections are conducted on all commercial properties with 4 or more storefronts in a contiguous row. The purpose of these inspections is to ensure that the property is in compliance with the Americans with Disabilities Act (ADA) and the California Disabled Persons Act (DPA). These laws require that all businesses provide disabled persons with access to their premises.
Randomized Access Inspections
Randomized Access Inspections are conducted on a random sample of commercial properties with 3 or fewer storefronts in a contiguous row. The purpose of these inspections is to ensure that the property is in compliance with the Americans with Disabilities Act (ADA) and the California Disabled Persons Act (DPA). In order to be selected for a Randomized Access Inspection, the property must be on the City’s active commercial business tax roll. Once selected, the property owner will be notified in writing and given at least 10 days notice prior to the inspection.
For-Cause Access Inspections
For-Cause Access Inspections are conducted when there is a complaint or other evidence that a commercial property is not in compliance with the Americans with Disabilities Act (ADA) or the California Disabled Persons Act (DPA). If an inspection finds deficiencies, a Notice of Violation (NOV) is issued. In addition, the Department may also refer the case to the Office of the City Attorney for possible prosecution as an infraction, misdemeanor, or felony.
